INFORMATION NOTE ON DATA PROCESSING

This site is owned and managed by the company HAPPY RECRUITER SA, based in Tirgu Mures, Str. Constantin Silvestri 9/1, Jud. Mures, registered with the Trade Register under no. J26 / 377/2010, CIF RO27016351, hereinafter referred to as Happy Recruiter.

Happy Recruiter is committed to protecting the privacy of its users and strives to provide a secure user experience. This privacy policy describes how we collect and use personal data collected through the site.

By using this site, you agree to the collection, processing, and transfer of your data, as described in this privacy policy.

If you do not want your information to be collected, used, and transferred as described in this policy, it is necessary to stop using our platform. If you express your option not to use your data, your account and profile information will be removed from our database.

The information collected on our websites and applications are stored in the European Union and are subject to Regulation 679/2016.

VERY IMPORTANT: This site is dedicated exclusively to personnel recruitment specialists. It is not a site dedicated to individuals who are looking for a job.

The information we collect

We collect information about you when you create a recruiter account:

  • Name, address, e-mail address, telephone number, country, and the company you represent.

We collect information about you when you use your recruiter account:

  • Log in data, information from interviews conducted with DORA's
  • Details about the recruitment announcements you have in progress
  • Data and information in the contact forms on the site when you write to us

How we use the information we collect

Your information is used by Happy Recruiter to execute the remote signed contract (Terms and Conditions)

We will use the information for the whole statistics regarding the productivity of the DORA solution.

In some cases, we will also use your information to protect the rights and property of Happy Recruiter, the rights of users, candidates, employees, or other interested persons, as required by law.

What is the legal basis for processing your personal data?

For processing the personal data of the recruiters who create an account for the use of the DORA solution, the legal basis of the processing is the execution of the remote contract.

For the processing of personal data in the process of monitoring the security of the application, the legal basis of the processing is the legitimate interest.

For the processing of personal data in the process of monitoring the application to improve it, the legal basis of the processing is the legitimate interest.

Last but not least, when processing is compulsory for the realization of public interest or for exercising the public authority because it is our responsibility, we will be entitled to process personal data.

Who can access your information

The information is not shared with third-party companies, except for service providers that make the DORA solution usable.

Happy Recruiter may sometimes be required to disclose your information to third parties, such as local authorities, courts and tribunals, regulatory bodies, and/or law enforcement agencies, to comply with applicable laws and regulations or in response to a legal procedure.

We will also share your personal information with third parties if we have your consent or to detect, prevent or otherwise address fraud, security breaches, or technical issues or to protect us from infringement of property rights or against infringement, the safety of Happy Recruiter, users, other candidates, employees and other data subjects, or in cases provided by law.

How do we share information with third parties?

We will disclose your personal data only for the purposes and to those third parties, as described below. Happy Recruiter SA will take the necessary measures to ensure that personal data are processed, secured, and transferred according to the law in force.

External service providers

Where necessary, we will assign other companies and individuals to perform certain tasks that contribute to our services on our behalf. We may, for example, provide personal data to agents, contractors, or partners for hosting our databases, for data processing services or to send you information that you have requested. We will share or make available to external service providers that information, to the extent necessary, to process your requests. This information may not be used by them for any other purpose, in particular not for their own purposes or for third parties. External service providers of Happy Recruiter SA are obliged by contract to respect the confidentiality of personal data.

Public bodies

We will only disclose your personal data to public bodies if this is required by law. For example, the Company will respond to requests from the courts, law enforcement agencies, regulatory agencies, and other public and official authorities, which may include such authorities and outside the country of residence.

International transfers of personal data

Your information may be transferred to recipients established outside the European Economic Area. We will ensure that all transfers take place following applicable data protection laws, including the conclusion of data transfer contracts if necessary.

Any transfers of personal data in countries other than those for which a decision has been made as to the adequacy of the level of data protection by the European Commission, as listed on the official websites, are made based on agreements contracts that use the standard contractual clauses adopted by the European Commission or other appropriate guarantees, following the law in force.

Business Transfers

In connection with any reorganization, restructuring, merger or sale or other transfer of assets (collectively referred to as "Business Transfer"), we will transfer data, including personal data, in a reasonable volume and as required for Business Transfer, and provided that the receiving party agrees to respect your personal data under the applicable data protection framework. The Company will continue to ensure the security and confidentiality of any personal data and notify affected users before personal data becomes the subject of another personal data processing policy.

How long will we keep personal data?

We do not store your personal data more than is necessary for the purpose for which we have retained them or to comply with a law or statutory requirement.

  • Data related to the account in the platform: until closing account in clear, and archived for 36 months after, to demonstrate the existence of a contract between parties.
  • The data in the contact form: 6 months from the moment of contact.

Your legal rights

As a data subject, you have specific legal rights regarding the personal data we collect from you. Happy Recruiter SA will respect your individual rights and will take care of your interests accordingly.

  • The right to rectification: You can obtain from us the rectification of personal data concerning you. We make reasonable efforts to keep personal data - which are used continuously and which are in our possession or control - accurate, complete, current, and relevant, based on the latest information available to us.
  • The right to restriction: You can obtain from us the restriction of processing of personal data, if:
    • you question the correctness of personal data for the period in which we must verify the accuracy,
    • the processing is illegal, and you request the restriction of processing rather than deletion of personal data personally,
    • we no longer need your personal data, but you ask them for finding, exercising or defending a right, or
    • you oppose the processing during the period when we check if our legitimate motives take precedence over yours.
  • Right of access: You can ask us for information about the personal data we hold about you, including information about what categories of personal data we have or control, what they are used for, where we have them collected, if not collected directly from you and to whom they were disclosed, if applicable. You can obtain a copy from us, free of charge, containing the personal data we hold about you. We reserve the right to charge a reasonable fee for each additional copy you may request.
  • Right to portability: Upon request, we will transfer your personal data to another operator, where technically possible, provided that the processing is based on your consent or is necessary for the performance of a contract. Rather than getting a copy of your data as a personal matter, you may request that we transfer your data directly to another operator, specified by you, if technically possible.
  • The right to delete: you can obtain from us the deletion of personal data, if:
    • your personal data are no longer necessary to us for the purposes for which they were collected or otherwise processed;
    • you have the right to oppose the further processing of personal data (see below) and to exercise this right of objection to the processing;
    • personal data have been processed illegally;

Unless the processing is necessary:

    • to fulfill a legal obligation that requires processing by us;
    • in particular for the legal requirements for data retention;
    • for finding, exercising, or defending a right.
  • Right of opposition: You can object - at any time - to the processing of personal data due to your special situation provided that the processing is not based on your consent, but on our legitimate interests or those of a third party. In this case, we will no longer process personal data unless we can demonstrate well-founded, legitimate reasons, and a major interest in the processing or in finding, exercising or defending a right. If you oppose the processing, please specify whether you want the deletion of personal data or the restriction of our processing by us.
  • Right to file a complaint: In the event of an alleged breach of the law in force regarding confidentiality, you can file a complaint with the data protection supervisory authority.

Please note:

Time period: We will try to fulfill the request within 30 days. However, the period may be extended for specific reasons regarding the specific legal law or the complexity of the request.

Restricting access: In certain situations, we may not be able to grant you access to all or part of your personal data due to legal provisions. If we refuse your request for access, we will inform you of the reason for the refusal.

Impossibility of identification: In some cases, we may not be able to search for your personal data because of the identification elements provided in your application. In such cases, in which we cannot identify you as the data subject, we are unable to comply with your request to exercise the legal rights as described in this section, unless you provide additional information that would allow you to identify yourself.
